Terms of Service
Last updated: March 12, 2026. These terms govern your use of the Guest OS platform and services provided by Hospitality Europe B.V.
1. Definitions
"Guest OS" or "we" refers to Hospitality Europe B.V., the company behind the Guest OS platform.
"Customer" or "you" refers to the hospitality property or organisation that has entered into an agreement with Guest OS to use the platform.
"Platform" refers to the Guest OS software, including all features, integrations, APIs and related services.
"Guest" refers to any individual whose data is processed through the platform on behalf of a Customer.
"Services" refers to the provision of the platform, support, onboarding and any additional services agreed upon.
2. Scope of services
Guest OS provides a hospitality operating system that automates guest communication, check-in workflows, task management, compliance and access delivery for hospitality properties.
The specific features and capabilities available to you depend on your subscription plan. We may update or modify features from time to time, and will provide reasonable notice of material changes.
Guest OS is provided as a Software-as-a-Service (SaaS) solution. You access the platform via web browser or API integrations. No software is installed on your premises.
3. Account and access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate and complete information when creating an account and keep this information up to date.
You may grant access to team members within your organisation. You are responsible for managing user permissions and ensuring that access is appropriate.
We reserve the right to suspend or terminate access if we reasonably believe that your account has been compromised or is being used in violation of these terms.
4. Customer responsibilities
You agree to use Guest OS in compliance with all applicable laws, including data protection regulations (GDPR), hospitality regulations and local registration requirements.
You are responsible for ensuring that guest data entered into the platform is collected lawfully and that appropriate consent or legal basis exists for its processing.
You must not use the platform for any unlawful purpose, to transmit harmful content, or to interfere with the operation of the platform or other users' access to it.
5. Data processing
When Guest OS processes personal data on your behalf (e.g. guest information), we act as a data processor under the GDPR. You remain the data controller.
A separate Data Processing Agreement (DPA) governs the processing of personal data and is incorporated into these terms by reference.
We implement appropriate technical and organisational measures to protect personal data, as described in our Privacy Policy and DPA.
6. Intellectual property
Guest OS retains all intellectual property rights in the platform, including software, design, documentation and trademarks.
Your subscription grants you a limited, non-exclusive, non-transferable licence to use the platform for your internal business operations during the term of your agreement.
You retain ownership of all data you enter into the platform. We do not claim any ownership rights over your data.
7. Availability and support
We aim to provide a reliable and available platform, with a target uptime of 99.5% measured on a monthly basis (excluding scheduled maintenance).
We provide customer support during business hours (CET) via email and in-platform messaging. Response times depend on your subscription plan.
We may perform scheduled maintenance from time to time and will provide reasonable advance notice of planned downtime where possible.
8. Fees and payment
Fees for the use of Guest OS are set out in your subscription agreement. All fees are exclusive of applicable taxes unless stated otherwise.
Invoices are issued monthly or annually, as agreed. Payment is due within 14 days of invoice date unless otherwise specified.
We reserve the right to adjust pricing with at least 60 days' written notice before the start of a new billing period.
9. Term and termination
Your subscription begins on the date specified in your agreement and continues for the agreed term. It renews automatically unless either party provides written notice of non-renewal at least 30 days before the end of the current term.
Either party may terminate the agreement with immediate effect if the other party materially breaches these terms and fails to remedy the breach within 30 days of written notice.
Upon termination, your access to the platform will cease. You may request an export of your data within 30 days of termination, after which we will delete your data in accordance with our retention policy.
10. Limitation of liability
To the maximum extent permitted by law, Guest OS's total liability for any claims arising from or related to these terms or the use of the platform shall not exceed the total fees paid by you in the 12 months preceding the claim.
Guest OS shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities.
Nothing in these terms limits liability for fraud, gross negligence or any other liability that cannot be excluded by law.
11. Governing law and disputes
These terms are governed by the laws of the Netherlands.
Any disputes arising from or in connection with these terms shall be submitted to the competent court in Amsterdam, the Netherlands.
12. Changes to these terms
We may update these terms from time to time. We will notify you of material changes at least 30 days in advance via email or through the platform.
Continued use of the platform after the effective date of updated terms constitutes acceptance of those terms.
